Terms and Conditions

Please carefully read the following terms and conditions. In completing and confirming a tour booking with Into The Wild, you agree to be bound by these conditions which form the agreement between The Adventure Factor Pty Ltd trading as Into the Wild and you (and your group).

Booking

At the time of booking no payment is required. Once your booking has been made you will receive email confirmation of a 'Pending Order'. The period in which a pending order becomes a confirmed order can take up to 24hrs. Once a booking is ‘Confirmed’ you will receive an email notification and a 20% deposit must be made within 48 hours to secure your booking.

If appropriate accommodation and catering cannot be provided. You will be contacted by either email or phone with alternative options.

Payment

Prices quoted on the website are in Australian dollars and include GST. Payments must be made by credit card or direct deposit. Cash is not accepted. All tours must pay a 20% deposit at the time of a confirmed booking, with the remaining balance due 30 days prior to tour start date.

Cancellations, changes & refunds

If you wish to change your booking, please notify Into the Wild in writing to bookings@gointothewild.com.au. Changes are not guaranteed and may incur additional charges. Into the Wild will notify you within 72 hours of your request to change your booking can be made, and if there are any additional charges. No changes can be made to a booking within 7 days of the confirmed booking.

If you wish to cancel your booking, please notify Into the Wild in writing to bookings@gointothewild.com.au 

Once Into the Wild receives your notice, cancellation will take effect subject to the following fees and conditions:

· Cooling off period: you may cancel your booking within the first 24 hours following the time your booking was placed.

· Cancellations outside 30 days of a confirmed tour will forfeit 20% of the total cost.

· Cancellations received between 30 to 7 days a confirmed booking tour will forfeit 50% of the total cost.

· 7 days or less: no refund will be provided.

Cancellation by Into the Wild

If Into the Wild has reason to cancel your booking, you will receive a full refund on the tour price paid to date.

Heli Biking Considerations

Heli Biking is highly dependent on weather, so your chosen dates may change by 1-2 days either side. Please remain adaptive to itinerary changes throughout, and book any flights with a 2-day buffer either side of your tour.

Providing exact weight measurements at time of booking is vital for heli biking operations. We only have a certain weight capacity to work within, and this needs to be provided for trip planning with our aircraft partner. If any weight measurements have been guessed, please take the time to record an accurate weight and resubmit to us via bookings@gointothewild.com.au.

Travel insurance

Personal travel insurance is not included in the price of the tour. It is a condition of booking with Into the Wild that you are adequately insured in respect of illness, injury, death, loss of baggage and personal items, damage to or loss of bicycle and cancellation or curtailment. It is your responsibility to make such insurance arrangements. (Australian residents, please note requirements for state by state ambulance cover and ensure you have appropriate cover in place).

Bike / accident insurance

Into the Wild accept no liability when transporting your bike and/or equipment for any accident or damages. It is your responsibility to ensure your bike is securely attached to our roadworthy and purpose build bike trailer. Bike insurance is not included in the price of the shuttle service and Into the Wild recommends you have your bike privately insured in case of a mishap, accident or damage. Into the Wild will not be liable for any additional bike hire expenses in the event your bike is damaged and not rideable.

Luggage / personal equipment

Into the Wild does allow for the carriage of luggage and passengers’ bikes and associated riding equipment. Into the Wild may refuse carriage of any equipment, if in its opinion the luggage is:

· unsafe;

· a hazardous substance or dangerous good;

· likely to be damaged during travel;

· likely to cause damage to our vehicle; or

· likely to cause damage to other passengers’ luggage or any other property.

In the event luggage is refused travel by Into the Wild, the passenger holds sole responsibility for any and all costs of alternate travel for their luggage. All luggage, including carry-on luggage, is the sole responsibility of the passenger. Into the Wild accepts no responsibility and will not be liable for any damage to, theft or loss of any passenger luggage whilst using our service, including when on board a vehicle. Personal travel insurance is not included, and adequate travel insurance is recommended prior to travel.

Route changes

Into the Wild reserves the right to modify any aspect of the tour, or postpone, cancel or delay any such aspect of the service if in the absolute discretion of the driver, if it is necessary to do so due to inclement weather, snow or icy conditions or conditions that are otherwise likely to be hazardous or dangerous or due to any other adverse or threatening conditions which may affect the safety of participants. Into the Wild reserves, in its absolute discretion, the right to cancel or postpone any tour due to any government or emergency services agency warning or advice, or any change in such warning or advice.

In the event of any change, modification, cancellation postponement or delay under this condition, you acknowledge that you will have no right of refund of the tour price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation postponement or delay. Travel insurance may compensate you depending on the circumstances.

Force majeure

If Into the Wild is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of act of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of terrorism, acts or omissions of a third party or any other cause whatsoever outside of Into the Wild’s reasonable control, Into the Wild will be under no liability to you and may, at its option, by written notice, either cancel the tour or arrange alternative tour arrangements.

Assumption of risk and safety declaration

Prior to undertaking any tour activities with Into the Wild, participants must sign a waiver and release of liability. A copy will be provided to all participants prior to tour commencing.  

By its nature mountain bike adventure activities can be more challenging and demanding with a commensurately high level of risk, and involve potential exposure to injury and possibly death. You are solely responsible for your riding and own judgement to participate within your capabilities and that you are solely responsible for your health and wellbeing.

You declare and acknowledge:

· The additional dangers and risk associated with mountain bike adventure travel may include difficult and dangerous terrain, extreme weather, including sudden and unexpected changes, remoteness from normal medical services and from communications and evacuation difficulties in the event of illness or injury.

· Falls and collisions which may cause serious injury can occur regardless of skill level. In consideration of participating in mountain biking activities. You assume all risks of and responsibility for property damage and injury to yourself or to others which may be associated with and/or result from your activities on the mountain bike trails, including, but not limited, to mountain biking related activities.

· You do not have any fitness, medical or physical conditions that would affect your participation in the activity. You authorise Into the Wild to arrange medical or hospital treatment as necessary and you agree to pay for all associated costs.

· Into the Wild reserves the right to withdraw any person who in their opinion is likely to endanger themselves or others. Into the Wild also reserves the right to cancel any activity if they become concerned for any reason for your safety or that of any other person.

· You must follow Into the Wild’s instructions and use any safety equipment provided at all times. For the above reason you accept the inherent and increased dangers and risks associated with the proposed adventure and the accompanying risk of injury, death or property damage or loss.

Into the Wild reserves the right to refuse travel or remove passengers from the vehicle, regardless of whether the passenger holds a valid ticket, where the passenger:

· Behaves in a disruptive, threatening or unlawful manner and may pose a threat to themselves, other passengers, staff or property; or

· is observed smoking, consuming alcohol or taking illicit drugs or attempting to smoke, consume alcohol or take illicit drugs on board.

In the event travel is refused or a passenger is removed from the vehicle, Into the Wild take no responsibility for inconvenience due to refusal of service, or for any additional cost or expense that may be incurred by you as a result of the refusal of service. Into the Wild will not provide a refund for the cost of the booking in this tour. 

You declare that you have not recently been required to isolate or quarantine and to the best of your knowledge, you have not been in contact with others who are infected with COVID-19 and that you are feeling well at the time of travel. You are aware of your responsibility to protect yourself and others and the control measures implemented by Into the Wild to manage the risk associated with COVID-19.

Unaccompanied minor policy

Children under the age of 18 years are not permitted to travel unaccompanied on tours conducted by Into the Wild.  All children under the age of 18 must be accompanied by an adult over the age of 18. Proof of age for the accompanied person may be requested and must be shown prior to the service being provided. If no identification is provided, travel may be refused for both passengers. Any costs incurred due to the refusal of service will be incurred by the customer. Into the Wild does not assume any liability for these costs.

The person accompanying the child under the age of 18 years old must accept full responsibility for the child during the journey.

Passengers travelling with medical condition(s)   

For passengers who have a medical condition it is recommended that you consult with your local GP/Doctor prior to undertaking tours. Please inform Into the Wild through the online waiver of any allergies, medical requirements and medications. In the event that a passenger becomes ill during their journey the appropriate emergency services will be contacted and the continuation of travel will be determined by the emergency services personnel.

Unclaimed luggage   

In the event a passenger leaves an item of luggage on an Into the Wild vehicle:

· Into the Wild will make all reasonable efforts to identify the owner of the luggage and notify them of the unclaimed luggage. Collection of the luggage will be the sole responsibility of the passenger.

· Any freight fees incurred in transporting the luggage to an alternate location will be borne solely by the passenger. Into the Wild will store the item as lost property for a period of 30 days unless the interested parts and Into the Wild make arrangements for longer storage times. Should the item remain unclaimed at the expiry of that storage period, the item will be disposed of at Into the Wild’s sole discretion.

· Into the Wild will not be liable for any loss, expense or inconvenience incurred by the passenger.

Digital representations

Into the Wild reserves the right to take and collect digital representations of our services and use these for advertising and public media activities. By accepting these terms and conditions, you accept that your image may, from time to time, be in the social media or associated websites or other media outlets. Into the Wild will not link these representations to your personal details without your consent. 

Drug and alcohol policy

Illicit drugs are illegal in Tasmania and Australia at all times. Their use and consumption is forbidden during any and all activities conducted by Into the Wild.

Where Into the Wild has reasonable suspicion that participant(s) are under the influence of illicit drugs they have the right and responsibility to remove the participant(s) from the tour and inform the relevant authorities. In this situation Into the Wild will bear no cost related to this situation. Participants who have consumed alcohol will voluntarily remove themselves from further mountain biking for the remainder of the day. Where Into the Wild have reasonable suspicion participants are under the influence of alcohol they have the right to remove said participant from further mountain biking activities for the day. You acknowledge that you will have no right of refund of the tour price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred.
